Abstract
There have been many vigilante actions recently. Many things can be contributing factors. Criminologically, vigilante acts occur because of an imbalance between the rights of perpetrators and victims. The victim did not receive compensation in the form of a verdict for the crime committed by the perpetrator against him. Public distrust of law enforcement officials is a sociological factor that causes vigilante violence. In addition, the influence of political development reforms. Reformation has the wrong meaning for some communities where they feel they have the freedom to act as they please regardless of the existing criminal law. Based on this background, several problems can be identified, namely: first, what are the factors that cause the occurrence of vigilante actions carried out by the community in a criminology perspective; Second What is the effort to overcome cases of vigilante actions carried out by the community. Through a method of combining normative juridical and empirical jurisdiction. Data sources used, namely: perimer data that uses secondary data interview methods consisting of legal materials perimer, tertiary, and tertiary. This thesis writer uses data collection techniques in the form of literature studies and field research. In this study the data were analyzed descriptively with qualitative analysis. | Additional Information: | Tindakan main hakim sendiri akhir-akhir ini begitu banyak ditemukan. Banyak hal dapat menjadi faktor penyebab. Secara kriminologi, tindakan main hakim sendiri terjadi adalah karena adanya ketidakseimbangan antara hak-hak pelaku dan korban. Karban tidak menerima kompensasi dalam bentuk pemidanaan pelaku karena kejahatan yang telah dilakukan oleh pelaku terhadap dirinya. Rasa ketidakpercayaan publik dari aparat penegak hukum menjadi faktor sosiologis yang menyebabkan terjadinya main hakim sendiri. Selain pengaruh perkembangan politik reformasi. Reformasi menimbulkan arti yang salah untuk beberapa komunitas dimana mereka merasa memiliki kebebasan untuk bertindak sesuka mereka terlepas dari hukum pidana yang ada. Berdasarkan latar berlakang tersebut dapat diidentifikasikan beberapa masalah yaitu : pertama, Apa faktor penyebab terjadinya tindakan main hakim sendiri yang dilakukan oleh masyarakat dalam perespektif kriminologi ; Kedua Bagaimana upaya penanggulangan terhadap kasus tindakan main hakim sendiri yang dilakukan oleh masyarakat. Melalui metode gabungan antara yuridis normatife dan yuridis empiris. Sumber data yang digunakan,yaitu : data perimer yang menggunakan metode wawancara data sekunder terdiri dari bahan hukum perimer, tersier, dan tersier. Penulis skripsi ini menggunakan teknik pengumpulan data dalam bentuk setudi kepustakaan dan penelitian lapangan. Pada penelitian ini data dianalisis secara deskriptif analisis dengan bentuk kualitatif. Tindakan main hakim sendiri yang dilakukan oleh masyarakat, terdapat beberapa faktor sehingga masyarakat bisa melakukan perbuatan main hakim sendiri terhadap pelaku tindak pidana, upaya yang dilakukan institusi penegak hukum dalam menanggulangi kejahatan khususnya perbuatan main hakim sendiri yang di lakukan oleh masyarakat, terdapat beberapa beberapa cara yang dilakukan yaitu melakukan upaya preventif (pencegahan) dan represif (penindakan).
