Abstract
ABSTRACT THE EFFORTS TO PREVENT CORRUPTION THROUGH THE ESTABLISHMENT OF GOODS PROCUREMENT WORK UNITS AND SERVICES ACCORDING TO INSTITUTIONAL REGULATIONS LKPP NO. 10 YEAR 2021 One of the obligations of the Government is to provide the people's needs in various forms in the form of goods, services, and infrastructure development in order to promote general welfare with social justice for all Indonesian people. Meeting the needs of goods and services is an important part in the administration of government. In its implementation, many corruption cases were found in these activities involving unscrupulous officials and private parties related to the procurement of goods and services. To minimize the occurrence of corruption in the procurement of goods and services, the Government established UKPBJ in each agency to become a credible and professional institution in the governance of the procurement of goods and services whose management refers to Presidential Decree No. 21 of 2021 and LKPP Regulation No. 10 of 2021. However, in its implementation, corruption is still common. On that basis, it is necessary to study the factors that cause corruption in the procurement of government goods and services, and how the efforts to prevent corruption by the Goods and Services Procurement Work Unit are in accordance with LKPP Institution Regulation Number 10 of 2021. This study uses a normative juridical research method. with a statue approach and a conceptual approach. The data source used is secondary data with data collection techniques, namely library research. The data analysis technique used is descriptive-qualitative data analysis. The results show that the factors that cause corruption in the procurement of government goods and services include: greed (getting personal gain), abuse of authority, and taking advantage of opportunities. Furthermore, efforts to prevent corruption in the procurement of goods and services by the Government as regulated in LKPP Institution Regulation Number 10 of 2021, namely: making UKPBJ a professional and competent work unit as a center of excellence in the procurement of government goods and services, affirmation in detail regarding the responsibilities of UKPBJ, UKPBJ must be able to play the role of a Procurement Agent who consistently implements the applicable laws and regulations, and the actors in the procurement of government goods and services must be independent (no conflict of interest). Pemenuhan kebutuhan barang dan jasa merupakan bagian yang penting dalam penyelenggaraan pemerintahan. Dalam pelaksanaannya, banyak ditemukan terjadinya tindak pidana korupsi dalam kegiatan tersebut yang melibatkan oknum pejabat dan pihak swasta yang terkait dengan kegiatan pengadaan barang dan jasa tersebut. Untuk meminimalisir terjadinya korupsi dalam kegiatan pengadaan barang dan jasa, Pemerintah membentuk UKPBJ di masing-masing instansi guna menjadi lembaga yang kredibel dan profesional dalam tata kelola pengadaan barang dan jasa yang pengelolaannya mengacu pada Perpres Nomor 21 Tahun 2021 dan Peraturan LKPP Nomor 10 Tahun 2021. Namun, dalam implementasinya masih sering terjadi tindak pidana korupsi. Atas dasar itu perlu dikaji apa saja faktor penyebab tindak pidana korupsi di pengadaan barang dan jasa pemerintah, dan bagaimana upaya pencegahan tindak pidana korupsi oleh Unit Kerja Pengadaan Barang dan Jasa sesuai dengan Peraturan Lembaga LKPP Nomor 10 Tahun 2021. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konsep. Sumber data yang digunakan adalah data sekunder dengan teknik pengumpulan data yaitu studi kepustakaan (library research). Teknik analisis data yang digunakan adalah analisis data deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa faktor-faktor yang menjadi sebab terjadi korupsi dalam pengadaan barang dan jasa pemerintah antara lain: keserakahan (memperoleh keuntungan pribadi), penyalahgunaan wewenang, dan memanfaatkan kesempatan. Selanjutnya, upaya-upaya pencegahan tindak pidana korupsi dalam pengadaan barang dan jasa oleh Pemerintah sebagaimana diatur dalam Peraturan Lembaga LKPP Nomor 10 Tahun 2021, yaitu: menjadikan UKPBJ sebagai unit kerja yang profesional dan kompeten menjadi pusat keunggulan dalam pengadaan barang/jasa pemerintah, adanya penegasan secara rinci mengenai tangggung jawab UKPBJ, UKPBJ harus mampu memerankan sebagai Agen Pengadaan yang konsisten melaksanakan Peraturan Perundangan yang berlaku, dan pelaku pengadaan barang/jasa pemerintah harus independen (tidak ada konflik kepentingan).
