Abstract

xi SETTLEMENT ANALYSIS RELATED TO RENTAL AGREEMENTS FOR RENTING A SHOPPING CENTER BUILDING LIPPO PLAZA IS CONNECTED WITH THE DATA CERTIFICATE (Case Study of Decision Number 61/Pdt.G/2020/PN Jkt.Tim) Yoga Nasrallah 1111150050 ABSTRACT All legal subjects, whether human or legal entities, can make an agreement that creates an engagement between the parties making the agreement. in Article 1338 of the Civil Code. Default means negligence, negligence, breach of contract, not fulfilling its obligations in the agreement. As for what is meant by default is a condition due to negligence or error, the debtor cannot fulfill the achievements as specified in the agreement. The problems discussed in this thesis are. How is the settlement of contractual lease defaults in the Civil Code? How are the legal consequences related to the rental agreement of the Lippo Plaza shopping center building associated with the Civil Code? The theory used in this study is the Legal Assurance Theory and the Default Theory. the data is in the form of secondary data, the data collection technique is in the form of library research, the data analysis is in the form of qualitative analysis, and the research location is at the Library of the Faculty of Law Untirta, J.CO Donut & Coffee and lippo plaza. The results show that the Lippo Plaza shopping center with J.CO. Donut & Coffee did not find a meeting point or settlement in accordance with the lease agreement and default in an agreement where J.CO Donut & Coffee did not carry out its obligations, actually and correctly. The author also suggests what is required by the Lippo Plaza shopping center. If it is agreed by both parties, then the name is no longer an extension but a new lease agreement and the renting party should respect what has been agreed until the end of the term of the agreement from the time the agreement is implemented. Additional Information: Semua subjek hukum baik manusia atau badan hukum dapat membuat suatu persetujuan yang menimbulkan perikatan diantara pihak-pihak yang membuat persetujuan tersebut. dalam Pasal 1338 KUHPerdata. wanprestasi berarti kelalaian, kealpaan, cidera janji, tidak menepati kewajibannya dalam perjanjian .Adapun yang dimaksud wanprestasi adalah suatu keadaan yang dikarenakan kelalaian atau kesalahannya, debitur tidak dapat memenuhi prestasi seperti yang telah ditentukan dalam perjanjian.Adapun Permasalahan yang di bahas dalam skripsi ini adalah.Bagaimana penyelesaian wanprestasi sewa menyewa hukum perjanjian dalam KUHPerdata? Bagaimana akibat hukum terkait perjanjian sewa menyewa bangunan pusat pembelanjaan lippo plaza dihubungkan dengan KUHPerdata?.teori yang digunakan dalam penelitian ini adalah Teori Kepastian Hukum dan Teori Wanprestasi.Dalam penelitian ini penulis menggunakan metode penelitian yuridis normatif, dengan spesifikasi penelitian berupa pendekatan deskriptif analitis, sumber datanya berupa data sekunder, teknik pengumpulan datanya berupa studi kepustakaan, analisis datanya berupa analisis kualitatif, serta lokasi penelitian di Perpustakaan Fakultas Hukum Untirta, J.CO Donut & Coffee dan lippo plaza.Hasil Penelitian Menunjukkan bahwa Pusat pembelanjaan lippo plaza dengan pihak J.CO Donut & Coffee tidak menemunkan titik temu atau penyelesaian sesuai dengan perjanjian sewa menyewa.dan wanprestasi dalam suatu persetujuan dimana J.CO Donut & Coffee tidak melaksanakan kewajibannya, secara nyata dan benar. Penulis juga menyarankan apa yang disyaratkan oleh Pusat pembelanjaan lippo plaza. Jika disepakati ke dua belah pihak, maka namanya bukan lagi perpanjangan melainkan perjanjian sewa yang baru dan sudah seharus nya pihak menyewa menghargai apa yang sudah di sepakati sampai habisnya jangka waktu perjanjian sejak saat perjanjian itu dilaksanakan.
