Abstract

December 2019 there was an outbreak of the Coronavirus Disease, the Covid-19 pandemic had an impact on all sectors; workers who don’t get their rights and obligations during this pandemic. The government has issued a policy that requires public to limit community activities to minimize losses from the impact of this pandemic, it one the legal efforts taken by workers toward companies that lose them. From the legal problems above, this research conducted by taking two identification problems. First, what is the impact of the policy of imposing restrictions on community activities on employees working at Grand Sahid Jaya? Second, how is the legal protection for employees at Grand Sahid Jaya? The theory used in this research is theory of legal protection and legal justice, the research method is a normative juridical legal with research specifications The legal materials applied were primary, secondary, and tertiary legal. The technique of collecting legal materials uses a analytical descriptive method, data analysis in the form of qualitative analysis, and research locations at the Untirta Faculty of Law Library, Hotel and Worker's Residence. It was found that legal protection and justice for the rights of workers at Grand Sahid Jaya didn’t meet the applicable provisions regarding the wages of workers. As for suggestions In this research, the company should pay attention to the condition of workers by paying attention to the rights of workers that must be fulfilled. that businessmen are required to pay full in the form of basic salary and incentive allowances during the Covid-19 pandemic, and are required to provide severance pay for workers who have been laid off and fired under the Article 156 of Law Number 13 Year 2003 About Employment.

Additional Information: Desember 2019 terjadi wabah Coronavirus Disease, adanya pandemi Covid-19 berdampak pada segala sektor. Salah satunya ialah tenaga kerja yang tidak mendapatkan hak dan kewajibannya selama masa pandemi ini karena pemerintah mengeluarkan kebijakan yang mengharuskan masyarakat untuk melakukan pembatasan kegiatan masyarakat guna meminimalisir kerugian dari dampak pandemi ini serta upaya hukum yang dilakukan oleh tenaga kerja terhadap perusahaan yang merugikannya. Dari adanya permasalahan hukum diatas, penulis melakukan penelitian dengan mengambil dua identifikasi masalah. Pertama, bagaimana dampak kebijakan pemberlakuan pembatasan kegiatan masyarakat terhadap pegawai yang bekerja di Grand Sahid Jaya? Kedua, bagaimana perlindungan hukum terhadap pegawai di Grand Sahid Jaya?. Teori yang digunakan penulis adalah Teori Perlindungan Hukum dan Keadilan hukum, metode penelitian yang digunakan penulis adalah yuridis normatif, dengan spesifikasi penelitian berupa deskriptif analitis, sumber datanya berupa data sekunder, teknik pengambilan datanya berupa studi kepustakaan, analisis datanya berupa analisis kualitatif, serta lokasi penelitian di Perpustakaan Fakultas Hukum Untirta, Hotel dan Kediaman Pekerja. Dari penelitian skripsi yang penulis lakukan, didapatkan hasil bahwasannya perlindungan hukum dan keadilan terhadap hak pekerja di Grand Sahid Jaya tidak memenuhi ketentuan yang berlaku mengenai upah para pekerja. Adapun saran sehubungan dengan penelitian ini, pihak perusahaan hendaknya memperhatikan keadaan pekerja dengan memperhatikan hak-hak para pekerja yang harus dipenuhi. Pihak perusahaan tetap wajib membayar upah secara penuh berupa upah pokok dan tunjangan tetap selama tenaga kerja dirumahkan dalam masa pandemi Covid-19 dan wajib memberikan uang pesangon bagi tenaga kerja yang di PHK sesuai dengan Pasal 156 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan.
