Abstract
Wiyanto Halim adalah pemilik hak atas sebidang tanah berdasarkan 5 Akta Jual Beli, kemudian wiyanto halim mengajukan permohonan pendaftaran konversi hak atas tanah ke kantor BPN Kota Tangerang, setelah di teliti ternyata sudah terbit SHM No. 49/Benda dan SHM No.51/Benda, berdasarkan data tersebut, BPN Kota Tangerang tidak dapat memproses pendaftaran konversi hak atas tanah, BPN akan memperoses jika SHM No. 49/Benda dan SHM No. 51/Benda tersebut dilakukan pembatalan. Atas dasar tersebut, maka wiyanto halim membawa sengketa tanah ini ke pengadilan, identifikasi masalah yang pertama Apakah pertimbangan hakim dalam putusan peninjauan Kembali No. 52 PK/PDT/2018 sudah tepat menurut hukum? Dan selanjutnya Bagaimana akibat hukum dari putusan peninjauan Kembali No. 52 PK/PDT/2018? Metode dalam penyusunan skripsi ini peneliti menggunakan tipe penelitian hukum yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual berdasarkan data sekunder yang ditunjang dengan data primer. Teknik pengumpulan data dengan studi dokumen. Data di analisis dengan metode yuridis kualitatif. Hasil penelitian dari putusan mahkamah agung No. 52/K/PDT/2018 Jo. Putusan Mahkamah Agung No. 2957/K/PDT/2015. Jo. Pengadilan Tinggi Banten No. 16/PDT/2015/PT.BTN. Jo. Pengadilan Negeri No. 645/Pdt.G/2013/Pn.TNG. dalam pertimbangannya Wiyanto Halim tidak mempunyai alas hak untuk didaftarkan sertifikat, karena Wiyanto Halim sudah menjual ke-5 AJB yang ingin ia daftarkan ke kantor BPN Kota Tangerang tersebut sudah terdaftar SHM No. 49/Benda dan SHM No. 51/Benda atas nama tergugat IV Nngsih Rahardja selaku ahli waris dari alm. Surja Mihardja.
