Abstract
Perjanjian Kredit Bank diatur dalam Pasal 1 angka 11 Undang-undang Nomor 10 Tahun 1998 tentang Perbankan, yaitu menyebutkan bahwa: “Kredit adalah penyediaan uang/tagihan yang dapat di persamakan dengan itu, berdasarkan persetujuan/kesepakatan pinjam–meminjam antara bank dengan pihak lain yang mewajibkan pihak peminjam wajib melunasi utangnya setelah jangka waktu tertentu dengan pemberian bunga”. Adapun yang menjadi permasalahan dalam skripsi ini adalah Bagaimana Penyelesaian Hukum apabila Debitur mengalami Kredit Macet, Bagaimana Akibat Hukum apabila Debitur wanprestasi. Jenis penelitian Yuridis Normatif (normative legal research) dengan teknik yang digunakan adalah pendekatan undang-undang (Statute Approach) dan kasus. Penelitian ini menggunakan data sekunder yang digunakan terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian diperoleh simpulan bahwa Upaya-upaya penyelesaian yang dilakukan oleh pihak Bank MayBank dalam hal kredit macet baik yang disebabkan karena piutang dagang macet, force majeure, maupun mismanajemen diselesaikan sesuai dengan ketentuan Pedoman Pelaksanaan Kredit yaitu restrukturisasi, Anggunan yang di jaminkan, Eksekusi Objek Jaminan Kebendaan, Penyelesaian Melalui Jalur Litigasi atau Nonlitigasi, Hapus Buku dan Hapus Tagih, dan kepailitan. Pihak Bank MayBank selalu mengupayakan suatu kredit macet dapat diselesaikan dengan terlebih dahulu melakukan penyelamatan kredit melalui restrukturisasi karena hal ini dinilai lebih menguntungkan pihak bank daripada bentuk penyelesaian yang lainnya, dengan dilakukannya restrukturisasi dan berhasil, maka akan mampu membuat koletibilitas suatu kredit menjadi lebih baik dan itu berarti akan mengurangi persentase NPL (Non Performing Loan) di Bank MayBank Indonesia yang secara otomatis akan menurunkan PPAP (Penyisihan Penghapusan Aktiva Produktif).

Additional Information: | The Bank Credit Agreement is regulated in Article 1 number 11 of Law Number 10 Year 1998 concerning Banking, which states that: "Credit is the provision of money / claims can be likened to that, based on a loan agreement between a bank and another party which requires the borrower to pay off its debt after a certain period of time with interest. As for the problem in this thesis is how the legal settlement if the debtor experiences bad credit, what are the legal consequences if the debtor defaults. This type of normative researchnormative legal research with the techniques used is the statute approach and cases. This study uses secondary data used consisting of primary legal materials, secondary legal materials and tertiary legal materials. The results of the research concluded that the settlement efforts made by Bank MayBank in the case of bad credit, whether due to bad trade receivables, force majeure, or mismanagement were settled in accordance with the provisions of the Credit Implementation Guidelines, namely restructuring, guaranteed collateral, and execution of collateral objects. Material, Settlement through Litigation or Nonlitigation, Write Off and Write Off Receivables, and bankruptcy. Bank MayBank always strives for a bad credit to be resolved by first carrying out credit rescue through restructuring because this is considered more profitable for the bank than other forms of settlement, by restructuring and successful, it will be able to make a credit collectibility better and that means that it will reduce the percentage of Non Performing Loan at Bank MayBank Indonesia which will automatically reduce Provision for Earning Asset Losses. | |||||||||
