Abstract
Ketetapan MPRS Nomor XXV/MPRS/1966 selalu diangaap membatasi kebebasan menyampaikan pikiran baik lisan maupun tertulisan dalam dinamika hak asasi manusia, maka identifikasi dari skripsi ini ialah Bagaimana Kedudukan TAP MPRS Nomor XXV/MPRS/1966 tentang ajaran komunis dalam tata hukum Indonesia dan Bagaimana Implikasi Ketetapan MPRS Nomor XXV/MPRS/1966 terhadap kemerdekaan yang mengeluarkan pikiran baik secara lisan maupun tertulis? Penelitian ini merupakan jenis penelitian kumulatif dengan metode pendekatan yuridis normatif, data yang digunakan adalah data sekunder berupa data kepustakaan dengan tiga bahan hukum yaitu bahan primer, bahan hukum sekunder dan bahan hukum tersier, kemudian dianalisis secara deskriptif analisis. Berdasarkan hasil analisis dan pembahasan, diperoleh kesimpulan kedudukan TAP MPRS Nomor XXV/MPRS/1966 yang berkaitan dengan larangan ajaran komunis dan partai komunis Indonesia (PKI). Ketetapan MPRS ini tidak menghambat kemerdekaan pikiran baik secara lisan maupun tulisan, karena TAP MPRS Nomor XXV/MPRS/1966 ini hanya melarangan kegiatan-kegiatan menyebarkan paham komunisme.

| Additional Information: | Decree of the MPRS Number XXV / MPRS / 1966 is always considered to limit the freedom to convey thoughts both orally and in writing in the dynamics of human rights, so the identification of this thesis is how the position of TAP MPRS Number XXV / MPRS / 1966 regarding communist teachings in the Indonesian legal system and what are the implications MPRS Decree Number XXV / MPRS / 1966 on independence that expresses thoughts both orally and in writing? This research is a type of cumulative research with a normative juridical approach, the data used are secondary data in the form of library data with three legal materials, namely primary materials, secondary legal materials and tertiary legal materials, then analyzed by descriptive analysis. Based on the results of the analysis and discussion, it was concluded that the position of TAP MPRS Number XXV / MPRS / 1966 was related to the prohibition of communist teachings and the Indonesian communist party (PKI). This MPRS decree does not hinder freedom of thought, either verbally or in writing, because this MPRS TAP Number XXV / MPRS / 1966 only prohibits activities to spread communism. | |||||||||
