Abstract
The existence of Identity Religion In Identity Card and Its Implication to Freedom of Religion For Residents Baduy Seen From 1945 has long been the case, in particular the areas of population, where they get different treatments religion column in the National Identity Card it is emptied because religion that they believe have not been officially recognized by the government.In this thesis, there are two issues that made the first research on how the religion's existence or the existence of Bedouin citizens in the Identity Card and the second on how the State guarantee against religious freedom Bedouin citizens under the Act of 1945.In this thesis research using normative juridical approach and empirical jurisdiction regarding implementation of normative legal provisions in action on any particular legal events that occur in a society. Data used using primary data and secondary data. Techniques in data collection with literature studies and field studies. Analysis of data using qualitative normatife method is to analyze the data according to kualyty.Spesifikasi research using descriptive analytical research that describes and outlines the facts in this case on the issue of inclusion of religion or religious beliefs Bedouin in identity cards which will then be analyzed in order to obtain a complete picture of problems to be studied.Results of the analysis of this thesis that not religion Sundanese dicantumkanya wiwitan the National Identity Card is quite contrary to the principle of the country of Justice Human.Dimana Indonesia as state laws because it injured the elements that are in a state of law for the same position in front the law for every citizen, of legal certainty and guarantee the protection of human rights. From the perspective of human rights with no written wiwitan Sundanese religion in national identity cards injure the religious freedom rights of citizens where these rights are rights that can not be dicaput by whoever including by state. Guarantee of the State to the problems faced by citizens Baduy already clearly state guarantees in the constitution of Article 28 and 29 of the 1945 Constitution but in practice the state still makes and enforces laws and regulations that are contrary to the content of the Constitution in the constitution and ideology of our nation that embraces the concept of religious freedom ideology Pancasila which our country will plural religion and belief. But the government still impose rules that conflict with the constitution and the gerund Norm State Indonesia.

| Additional Information: | Keberadaan Identitas Agama Dalam Kartu Tanda Penduduk dan Implikasinya Terhadap Kebebasan Beragama Bagi Warga Baduy Ditinjau Dari UUD 1945 telah lama terjadi, khususnya bidang kependudukan, dimana mereka mendapatkan perlakuan yang berbeda kolom agama dalam Kartu Tanda Penduduk nya dikosongkan karena agama yang mereka yakini belum diakui secara resmi oleh pemerintah.Dalam tesis ini ada dua permasalahan yang dijadikan penelitian yang pertama tentang bagaimanakah existensi atau keberadaan agama warga Baduy dalam Kartu Tanda Penduduk dan yang kedua tentang bagaimana jaminan Negara terhadap kebebasaan beragama warga Baduy menurut Undang-Undang Dasar 1945.Dalam penelitian tesis ini menggunakan pendekatan yuridis normatif dan yuridis empiris mengenai implementasi ketentuan hukum normatif dalam aksinya pada setiap peristiwa hukum tertentu yang terjadi dalam suatu masyarakat. Data yang digunakan menggunakan data primer dan data sekunder. Tekhnik dalam pengumpulan data dengan studi kepustakaan dan studi lapangan. Analisis data menggunakan metode normatife kualitatif yaitu menganalisa data sesuai dengan kualitasnya.Spesifikasi penelitian menggunakan penelitian deskritif analitis yang menggambarkan dan menguraikan fakta yang ada dalam hal ini tentang permasalahan pencantuman agama atau kepercayaan agama Baduy dalam kartu tanda penduduk yang kemudian akan dianalisa guna memperoleh gambaran utuh tentang permasalahan yang akan diteliti.Hasil dari analisis tesis ini bahwa dengan tidak dicantumkanya agama sunda wiwitan dalam Kartu Tanda Penduduk ini sangat bertentangan dengan prinsip negara Hukum dan Hak Asasi Manusia.Dimana Indonesia sebagai negara hukum hal ini menciderai karena unsur- unsur yang ada didalam negara hukum adanya kedudukan yang sama didepan hukum bagi setiap warga Negara, kepastian hukum dan adanya jaminan perlindungan Hak Asasi Manusia. Dari perspektif Hak Asasi Manusia dengan tidak ditulisnya agama sunda wiwitan dalam Kartu tanda penduduk menciderai Hak kebebasan beragama warga negara dimana hak ini merupakan hak yang tidak bisa dicaput oleh siapaun termasuk oleh negara. Jaminan Negara terhadap permasalahan yang dihadapi Warga baduy sudah jelas negara menjamin di dalam konstitusi pasal 28 dan 29 UUD 1945 tetapi dalam prakteknya negara masih membuat dan memberlakukan peraturan perundang-undangan yang bertentangan dengan isi Konstitusi dalam konstitusi dan ideology bangsa kita yang menganut konsep kebebasan beragama berideologi Pancasila dimana negara kita plural akan agama dan keyakinan. Tetapi pemerintah masih memberlakukan peraturan yang bertentangan dengan konstitusi dan Gerund Norm Negara Indonesia | |||||||||
