Abstract

The Supreme Court realized that all this buildup peradialan case at every level, both in the PN, PT and MA. To cope with the buildup of the case the Supreme Court to make rules that Perma menagtur terintegarasi mediation procedures with the judicial process, the expectations of the parties to the dispute in the courts to reach a peace agreement through the mediation process, not by taking that are adjudicative settlement (resulting in court decisions). Initially released Perma Number 2 in 2003 which was the implementation of mediation in court ineffective. Therefore, it was changed to the Perma Number 1 in 2008. The purpose of this study was to analyze whether the normative juridical No. Perma. 1 Year 2003 can be a factor that affects the effectiveness of the mediation process in the District Court. The purpose of this study was to analyze normative whether Perma No. 1 of 2008 may be the factors that influence the effectiveness of the mediation process in the District Court. The results of the study showed that Perma No.1 of 2008 is one of the factors that influence the effectiveness of the mediation procedure in the District Court with a variety of provisions that could lead to an effective mediation procedure including the enactment of mandatory powers, the availability of various qualified mediator which can be chosen by the parties, the cost of calling parties while charged kepaada Plaintiffs, and the provision of mechanisms and procedures for mediation at the appellate level, cassation, review and mediation outside the court.

Additional Information:	Mahkamah Agung menyadari bahwa selama ini terjadi penumpukan perkara di setiap tingkat peradilan, baik di tingkat PN, PT maupun MA. Untuk mengatasi penumpukan perkara tersebut Mahkamah Agung membuat peraturan Perma yang mengatur tentang prosedur mediasi yang terintegarasi dengan proses peradilan, dengan harapan para pihak yang bersengketa di pengadilan dapat mencapai kesepakatan perdamaian melalui proses mediasi, tidak dengan cara menempuh penyelesaian perkara yang bersifat ajudikatif (menghasilakan putusan pengadilan). Pada awalnya dikeluarkan Perma No.2 Tahun 2003 yang ternyata pelaksanaan mediasi di pengadilan tidak efektif. Oleh karena itu Perma tersebut dirubah dengan Perma No.1 Tahun 2008. Tujuan penelitian ini adalah ingin menganalisa secara yuridis normatif apakah Perma No. 1 Tahun 2008 dapat menjadi faktor yang mempengaruhi efektifitas proses mediasi di Pengadilan Negeri. Adapun hasil dari penelitian menunjukkan bahwa Perma No.1 Tahun 2008 merupakan salah satu faktor yang mempengaruhi efektifitas prosedur mediasi di Pengadilan Negeri dengan berbagai macam ketentuan-ketentuan yang bisa menyebabkan prosedur mediasi efektif diantaranya adalah kekuatan berlakunya yang bersifat wajib, ketersediaan bermacam-macam kualifikasi mediator yang dapat dipilih oleh para pihak, biaya pemanggilan para pihak yang sementara dibebankan kepaada Penggugat, dan adanya ketentuan tentang mekanisme dan prosedur mediasi pada tingkat banding, kasasi, peninjauan kembali dan mediasi diluar pengadilan.
