Many victims of phishing have yet to receive protection against what they have experienced; the losses resulting from phishing are not only borne directly by the victims but also have an impact on their families’ finances. However, victims often fail to receive protection due to the complexity of the reporting process. One of the causes of phishing is the victims’ lack of awareness regarding the evolution of digital crime. This study aims to analyze the legal protections available to victims of phishing crimes in electronic banking and how victims may contribute to the occurrence of phishing crimes. The method used is a normative legal approach with a descriptive-analytical focus, utilizing secondary data analyzed qualitatively. The research findings indicate that legal protection for victims of phishing crimes must include both preventive and repressive measures. Preventive measures involve raising awareness about personal data security and the methods used in digital crimes, as well as strengthening digital operational security standards and enhancing oversight of banking institutions. Repressive measures aim to resolve issues, including through the judicial system. The victim’s role is one of the factors contributing to phishing crimes; specifically, a lack of emotional stability and gullibility, a lack of caution, and a tendency to accept information without verifying its accuracy all of which lead to a lack of vigilance are key factors driving victims to fall prey to phishing.
