business that possesses economic value and is kept confidential by the trade secret&#13;
owner. The protection of trade secrets has legal provisions stipulated in the&#13;
Indonesian Trade Secret Law (UURD), but the implementation of this protection&#13;
faces obstacles, such as those found in the Productivity Improvement Consulting&#13;
Program. In this program, the Researcher conducted an analysis with two problem&#13;
identifications. First, how is the Non-Disclosure Agreement (NDA) regulated in the&#13;
cooperation organized by the Banten Province Manpower and Transmigration&#13;
Office and PT Integrasi Produktivitas Indonesia? Second, what is the legal&#13;
protection for trade secret owners involved in the Productivity Improvement&#13;
Consulting project based on the UURD? The theories used by the Researcher in&#13;
this study are the Theory of Legal Certainty and the Theory of Legal Protection.&#13;
The research method used is juridical-empirical, utilizing primary, secondary, and&#13;
tertiary legal materials. Data collection techniques involved literature review and&#13;
interviews. All data were analyzed qualitatively. The results show that the NDA&#13;
regulation was not implemented by the Banten Province Manpower and&#13;
Transmigration Office and PT Integrasi Produktivitas Indonesia in the Productivity&#13;
Improvement Consulting Program, thus failing to provide legal certainty regarding&#13;
the confidential information disclosed by the Company. Legal protection based on&#13;
Article 5 paragraph (1) letter d of the UURD can be applied by creating a written&#13;
agreement, however, the Company did not make efforts to protect its confidential&#13;
information. Therefore, legal protection cannot be granted to the Company. The&#13;
research suggestions are that NDA regulations should be made in accordance with&#13;
the UURD, and the government should socialize the protection of trade secrets to&#13;
