      "abstract": "Trade secret is information unknown to the public in the fields of technology and\r\nbusiness that possesses economic value and is kept confidential by the trade secret\r\nowner. The protection of trade secrets has legal provisions stipulated in the\r\nIndonesian Trade Secret Law (UURD), but the implementation of this protection\r\nfaces obstacles, such as those found in the Productivity Improvement Consulting\r\nProgram. In this program, the Researcher conducted an analysis with two problem\r\nidentifications. First, how is the Non-Disclosure Agreement (NDA) regulated in the\r\ncooperation organized by the Banten Province Manpower and Transmigration\r\nOffice and PT Integrasi Produktivitas Indonesia? Second, what is the legal\r\nprotection for trade secret owners involved in the Productivity Improvement\r\nConsulting project based on the UURD? The theories used by the Researcher in\r\nthis study are the Theory of Legal Certainty and the Theory of Legal Protection.\r\nThe research method used is juridical-empirical, utilizing primary, secondary, and\r\ntertiary legal materials. Data collection techniques involved literature review and\r\ninterviews. All data were analyzed qualitatively. The results show that the NDA\r\nregulation was not implemented by the Banten Province Manpower and\r\nTransmigration Office and PT Integrasi Produktivitas Indonesia in the Productivity\r\nImprovement Consulting Program, thus failing to provide legal certainty regarding\r\nthe confidential information disclosed by the Company. Legal protection based on\r\nArticle 5 paragraph (1) letter d of the UURD can be applied by creating a written\r\nagreement, however, the Company did not make efforts to protect its confidential\r\ninformation. Therefore, legal protection cannot be granted to the Company. The\r\nresearch suggestions are that NDA regulations should be made in accordance with\r\nthe UURD, and the government should socialize the protection of trade secrets to\r\nrelevant companies",

      "note": "Rahasia dagang adalah informasi yang tidak diketahui oleh umum di bidang\r\nteknologi dan bisnis yang mempunyai nilai ekonomis dan dijaga kerahasiannya\r\noleh pemilik rahasia dagang. Perlindungan rahasia dagang memiliki pengaturan\r\nhukum yang tertuang dalam UURD, tetapi pelaksanaan perlindungannya memiliki\r\nkendala seperti yang terdapat dalam program Bimbingan Konsultansi Peningkatan\r\nProduktivitas. Adapun dalam program tersebut Peneliti melakukan analisa dengan\r\ndua identifikasi masalah. Pertama, bagaimana pengaturan Non-Disclosure\r\nAgreement dalam kerjasama yang diselenggarakan oleh Dinas Tenaga Kerja dan\r\nTransmigrasi Provinsi Banten, dan PT Integrasi Produktivitas Indonesia? Kedua,\r\nbagaimana perlindungan hukum pemilik rahasia dagang yang terlibat dalam proyek\r\nBimbingan Konsultansi Peningkatan Produktivitas berdasarkan UURD?. Teori\r\nyang digunakan Peneliti dalam penelitian ini adalah Teori Kepastian Hukum dan\r\nTeori Perlindungan Hukum. Metode penelitian yang digunakan Peneliti adalah\r\nyuridis empiris, dengan menggunakan bahan hukum primer, sekunder, serta tersier.\r\nTeknik pengumpulan data dengan studi kepustakaan dan wawancara. Seluruh data\r\ndianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pengaturan NDA\r\ntidak dilaksanakan oleh Dinas Tenaga Kerja dan Transmigrasi Provinsi Banten, dan\r\nPT Integrasi Produktivitas Indonesia dalam Program Bimbingan Konsultansi\r\nPeningkatan Produktivitas, sehingga tidak mendapatkan kepastian hukum terhadap\r\ninformasi rahasia yang telah diungkapkan oleh pihak Perusahaan. Perlindungan\r\nhukum berdasarkan Pasal 5 ayat (1) huruf d UURD dapat diterapkan dengan\r\nmembuat perjanjian tertulis, akan tetapi pihak Perusahaan tidak melakukan upaya\r\nperlindungan terhadap informasi rahasianya. Oleh karena itu, perlindungan hukum\r\ntidak dapat diberikan kepada pihak perusahaan.
