The first issue examined in this study is how the construction of criminal acts of corruption against the role of active perpetrators is based on a study of case number 22/Pid.Sus-TPK/2023/Pn Srg and what are the legal implications of the Public Prosecutor's indictment, which ignores the role of active perpetrators, on case number 22/Pid.Sus-TPK/2023/ Pn Srg. The theories used in this study are the theory of criminal responsibility and the theory of evidence, using qualitative research methods with a normative legal research type. The data sources used are secondary data sources containing three types of legal materials, namely primary legal materials, secondary legal materials, and tertiary legal materials, with descriptive analysis techniques. This study found that the failure to construct the active role of Restia Dian Aini in case number 22/Pid.Sus-TPK/2023/Pn Srg could result in the indictment not fulfilling the material elements, which would imply a weak evidence process leading to the verdict issued by the judge. However, Restia Dian Aini can still be held criminally liable by splitting the case files. The conclusion of this study is that the Public Prosecutor is also responsible for his actions in not constructing the role of Restia Dian Aini in the Public Prosecutor's indictment, which has implications for the obscuur libel indictment on material requirements and results in the evidence process not being proven.
