"Customary inheritance law is customary law that regulates the system of\r\ninheritance procedures. In Indonesia, there are three different inheritance systems\r\nbased on customary law, namely the individual, collective and majorat systems.\r\nMeanwhile, there are 4 (four) types of kinship systems in Indonesia, namely\r\npatrilineal, matrilineal, bilateral or parental and alternating kinship systems.\r\nBaduy people basically adhere to the customs and customs they adopted from their\r\nancestors. The inheritance system used in Baduy customary inheritance uses a\r\nbilateral system, namely from father to mother who are equally powerful.\r\nIdentification of the problem in this research, namely how customary inheritance is\r\ndistributed for Baduy women, as well as the role of customary inheritance law in\r\nprotecting women's rights from the perspective of Law Number 39 of 1999\r\nconcerning human rights. The theories used in this research are the theory of justice\r\nand the theory of legal certainty. The research method used is Empirical Juridical,\r\nwith a statutory approach, conceptual approach and case approach. The data\r\nsources are primary data and secondary data. The data analysis uses qualitative\r\ndescriptive data analysis. The results and discussion in this research show that the\r\ndistribution of inheritance in the inheritance system of Baduy society adheres to a\r\nbilateral principle, where the position of men and women is relatively equal. Baduy\r\nwomen do not experience discrimination in obtaining inheritance rights, because\r\ndistribution is carried out fairly based on family deliberations and applicable\r\ncustoms. Baduy customary law is substantially in line with the principles of nondiscrimination and functional equality which prioritize social responsibilities and\r\nroles as regulated in Law Number 39 of 1999 concerning Human Rights. Thus,\r\nBaduy customary inheritance law plays an important role in maintaining justice,\r\ncertainty and protection of women's rights, while maintaining local cultural values"^^ .
