description: Customary inheritance law is customary law that regulates the system of  inheritance procedures. In Indonesia, there are three different inheritance systems  based on customary law, namely the individual, collective and majorat systems.  Meanwhile, there are 4 (four) types of kinship systems in Indonesia, namely  patrilineal, matrilineal, bilateral or parental and alternating kinship systems.  Baduy people basically adhere to the customs and customs they adopted from their  ancestors. The inheritance system used in Baduy customary inheritance uses a  bilateral system, namely from father to mother who are equally powerful.  Identification of the problem in this research, namely how customary inheritance is  distributed for Baduy women, as well as the role of customary inheritance law in  protecting women's rights from the perspective of Law Number 39 of 1999  concerning human rights. The theories used in this research are the theory of justice  and the theory of legal certainty. The research method used is Empirical Juridical,  with a statutory approach, conceptual approach and case approach. The data  sources are primary data and secondary data. The data analysis uses qualitative  descriptive data analysis. The results and discussion in this research show that the  distribution of inheritance in the inheritance system of Baduy society adheres to a  bilateral principle, where the position of men and women is relatively equal. Baduy  women do not experience discrimination in obtaining inheritance rights, because  distribution is carried out fairly based on family deliberations and applicable  customs. Baduy customary law is substantially in line with the principles of nondiscrimination and functional equality which prioritize social responsibilities and  roles as regulated in Law Number 39 of 1999 concerning Human Rights. Thus,  Baduy customary inheritance law plays an important role in maintaining justice,  certainty and protection of women's rights, while maintaining local cultural values
