This paradigm shift is contained in the provisions on conditional death penalty, which provides for a ten-year probation period for death row inmates with the possibility of \r\ncommuting the death penalty to life imprisonment and life imprisonment to a temporary prison sentence of twenty years if the death row inmate demonstrates “good behavior and conduct.” The New Criminal Code does not explicitly explain the parameters of “praiseworthy conduct and behavior,” which ultimately leads to legal ambiguity (vague norm). This study aims to determine the legal considerations \r\nin formulating the probation period and the concept of “good behavior” for death row inmates, as well as to determine the parameters of “good behavior” for death \r\nrow inmates who are undergoing probation under Article 100 of Law Number 1 of 2023 with the change of the death penalty to life imprisonment or imprisonment for 20 years. Based on its objectives, this study uses a normative-empirical legal research method with a qualitative research type. The normative approach is carried out through a review of legislation and criminalization theory to examine the objectives and direction of conditional death penalty policy, while the empirical approach is carried out through interviews and case studies to observe the application of the “praiseworthy attitude and actions” parameter in correctional practice. The results of the study show that Article 100 of the New Criminal Code is in line with the humanistic and rehabilitative objectives of punishment. However, the absence of objective and measurable parameters regarding “praiseworthy attitudes \r\nand deeds,” the limitations of correctional institutions, and the lack of technical guidelines for implementation have the potential to cause injustice in its application. \r\nTherefore, it is necessary to formulate clear assessment standards and transparent monitoring mechanisms so that the objectives of punishment and substantive justice can be achieved in a balanced manner."^^ .
