      "note": "Pelaksanaan penyelesaian perkara anak yang berkonflik dengan hukum melalui\r\npendekatan diversi, sebagaimana dirumuskan dalam Undang-Undang Nomor 11\r\nTahun 2012 tentang Sistem Peradilan Pidana Anak serta didukung pengaturan\r\nkelembagaan dalam Peraturan Kepala Kepolisian Negara Republik Indonesia\r\nNomor 10 Tahun 2007 mengenai Unit Pelayanan Perempuan dan Anak, pada\r\npraktiknya belum terlaksana secara maksimal di tingkat Kepolisian Sektor Taman\r\nSari yang belum memiliki Unit Perlindungan Perempuan dan Anak. Penelitian ini\r\nbertujuan untuk mengetahui penyelesaian dan penerapan diversi di Polsek yang\r\ntidak memiliki Unit Pelayanan Perempuan dan Anak, serta menganalisis\r\npemenuhan hak kepada anak sebagai korban yang melakukan penyelesaian perkara\r\nmelalui diversi. Teori yang digunakan dalam penelitian ini yaitu teori penegakan\r\nhukum dan teori perlindungan hukum. Penulisan ini merupakan jenis penelitian\r\nkualitatif dan menggunakan metode penelitian yuridis normatif. Data yang\r\ndigunakan yaitu data sekunder berupa perundang-undangan, serta data primer yang\r\ndiperoleh dari wawancara dengan Staff Reskrim Polsek Taman Sari. Teknik\r\npengumpulan data dilakukan melalui studi kepustakaan dan studi lapangan, lalu\r\ndianalisis secara deskriptif-analitis. Temuan penelitian menunjukkan bahwa\r\npelaksanaan diversi terjadi pada Kepolisian Sektor yang tidak memiliki Unit\r\nPelayanan Perempuan dan Anak dilakukan tanpa melibatkan maupun berkoordinasi\r\ndengan UPPA di tingkat Polres. Sebagai alternatif, Polsek menghadirkan Pusat\r\nPelayanan Perlindungan Perempuan dan Anak dalam mendampingi proses diversi.\r\nTemuan hasil penyelesaian yang hanya berupa permintaan maaf tanpa pemberian\r\nganti rugi tidak memberikan pemulihan yang proporsional terhadap kerugian fisik\r\nmaupun psikologis korban. Penelitian ini merekomendasikan perlu dilakukan\r\nperluasan pembentukan Unit PPA hingga tingkat Polsek atau penugasan penyidik\r\nanak dan pengaturan yang tegas mengenai kewajiban dan batasan jumlah ganti rugi\r\ndalam pelaksanaan diversi.",

      "abstract": "The implementation of resolving cases involving children in conflict with the law\r\nthrough a diversion approach, as stipulated in Law Number 11 of 2012 concerning\r\nthe Juvenile Criminal Justice System and supported by institutional regulations in\r\nthe Regulation of the Chief of the Indonesian National Police Number 10 of 2007\r\nconcerning the Women and Children Service Unit, has in practice not been\r\noptimally carried out at the Taman Sari Sector Police, which does not have a\r\nWomen and Children Service Unit. This study aims to examine the resolution and\r\napplication of diversion at police sector offices that do not have a Women and\r\nChildren Service Unit, as well as to analyze the fulfillment of the rights of children\r\nas victims in cases resolved through diversion. The theories applied in this study\r\nare law enforcement theory and legal protection theory. This research is qualitative\r\nin nature and employs a normative juridical research method. The data used consist\r\nof secondary data in the form of legislation, as well as primary data obtained\r\nthrough interviews with Criminal Investigation Unit staff at the Taman Sari Sector\r\nPolice. Data collection techniques include library research and field research,\r\nwhich are then analyzed using descriptive-analytical methods. The findings indicate\r\nthat the implementation of diversion at sector police offices without a Women and\r\nChildren Service Unit is carried out without involving or coordinating with the\r\nWomen and Children Service Unit at the district police level. As an alternative, the\r\nsector police involve the Women and Children Protection Service Center to assist\r\nin the diversion process. The results of case resolution, which are limited to an\r\napology without compensation, fail to provide proportional recovery for the\r\nphysical and psychological harm suffered by the victims. This study recommends\r\nexpanding the establishment of Women and Children Service Units to the sector\r\npolice level or assigning child investigators, as well as implementing clear\r\nregulations regarding the obligation and limits of compensation in the diversion\r\nprocess.",
