The misuse of this technology poses a serious threat to the privacy, reputation, and security of society. The purpose of this paper is to determine how the implementation of the Electronic Information and Transaction Law applies to cases of cyber deepfakes containing hoax videos in Indonesia, as well as the urgency of reformulating its regulations from the perspective of criminal law reform. This study uses the criminal law policy theory of Barda Nawawi Arief and Marc Ancel and the criminal law reform theory of Barda Nawawi Arief as its analytical tools. The research method used is empirical juridical with a legislative and comparative approach, through data collection using descriptive analysis. The results show that the enforcement of the ITE Law against deepfake cases is still weak due to normative gaps, the limitations of law enforcement officials, and the absence of regulations governing the responsibility of AI developers. The conclusion of this study emphasizes the need for criminal law reform through the reformulation of the ITE Law so that it can cover AI-based crimes with reference to international practices such as the EU AI Act and China Deep Synthesis Provisions.
