Such actions create legal uncertainty and often result in the neglect of workers’ rights. This research is motivated by the practice of verbal termination imposed on PKWT workers, as demonstrated in Case Decision Number&#13;
20/Pdt.Sus-PHI/2024/PN Sby and Decision Number 927 K/Pdt.Sus-PHI/2024, which indicate violations of statutory provisions regarding termination mechanisms and the fulfillment of workers’ rights. Based on this background, the study identifies two main issues: first, the form of legal protection afforded to PKWT workers who experience termination, and second, the judicial considerations in&#13;
resolving termination disputes involving PKWT workers in the aforementioned decisions. This research employs a normative juridical method with statutory, conceptual, and case approaches through the analysis of labor regulations, legal literature, and relevant court decisions. The findings reveal that PKWT workers terminated before the expiration of their contract are legally entitled to compensation and damages for the remaining contract period in accordance with Article 62 of the Manpower Act and the provisions of Government Regulation Number 35 of 2021. Moreover, verbal termination without written notification contravenes formal termination procedures and is therefore categorized as procedurally defective. In their considerations, both the first-instance court and the Supreme Court concluded that the employer failed to prove a lawful basis for the termination, thereby obligating the company to provide full compensation to the worker. These rulings affirm legal certainty for PKWT workers and establish an important precedent that employers cannot unilaterally terminate contracts without lawful grounds and proper procedures. Thus, this study underscores that legal protection for PKWT workers is essential to prevent arbitrariness and ensure the fulfillment of workers’ rights within the industrial relations system.&#13;
