      "abstract": "Termination of employment of workers under Fixed-Term Employment Agreements (PKWT) remains a critical issue in industrial relations, particularly when employers unilaterally terminate contracts without complying with applicable legal procedures. Such actions create legal uncertainty and often result in the neglect of workers’ rights. This research is motivated by the practice of verbal termination imposed on PKWT workers, as demonstrated in Case Decision Number\r\n20\/Pdt.Sus-PHI\/2024\/PN Sby and Decision Number 927 K\/Pdt.Sus-PHI\/2024, which indicate violations of statutory provisions regarding termination mechanisms and the fulfillment of workers’ rights. Based on this background, the study identifies two main issues: first, the form of legal protection afforded to PKWT workers who experience termination, and second, the judicial considerations in\r\nresolving termination disputes involving PKWT workers in the aforementioned decisions. This research employs a normative juridical method with statutory, conceptual, and case approaches through the analysis of labor regulations, legal literature, and relevant court decisions. The findings reveal that PKWT workers terminated before the expiration of their contract are legally entitled to compensation and damages for the remaining contract period in accordance with Article 62 of the Manpower Act and the provisions of Government Regulation Number 35 of 2021. Moreover, verbal termination without written notification contravenes formal termination procedures and is therefore categorized as procedurally defective. In their considerations, both the first-instance court and the Supreme Court concluded that the employer failed to prove a lawful basis for the termination, thereby obligating the company to provide full compensation to the worker. These rulings affirm legal certainty for PKWT workers and establish an important precedent that employers cannot unilaterally terminate contracts without lawful grounds and proper procedures.       "note": "Pemutusan hubungan kerja (PHK) terhadap pekerja dengan Perjanjian Kerja Waktu Tertentu (PKWT) masih menjadi isu krusial dalam hubungan industrial, khususnya ketika pengusaha melakukan pemutusan kontrak secara sepihak tanpa memenuhi prosedur hukum yang berlaku. Kondisi tersebut menimbulkan ketidakpastian hukum dan seringkali mengakibatkan terabaikannya hak-hak pekerja. Penelitian ini\r\ndilatarbelakangi oleh adanya praktik PHK yang dilakukan secara lisan terhadap pekerja PKWT, sebagaimana terjadi dalam perkara pada Putusan Nomor 20\/Pdt.Sus-PHI\/2024\/PN Sby dan Putusan Nomor 927 K\/Pdt.Sus-PHI\/2024, yang menunjukkan indikasi pelanggaran terhadap ketentuan peraturan perundangundangan mengenai mekanisme PHK dan pemenuhan hak pekerja. Berdasarkan hal tersebut, penelitian ini mengidentifikasi dua permasalahan utama yaitu bagaimana bentuk perlindungan hukum terhadap pekerja PKWT yang mengalami PHK, dan bagaimana pertimbangan hakim dalam memutus sengketa PHK terhadap pekerja PKWT dalam kedua putusan tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, melalui analisis terhadap regulasi ketenagakerjaan, literatur hukum, serta putusan pengadilan terkait. Hasil penelitian menunjukkan bahwa pekerja PKWT yang\r\nmengalami PHK sebelum berakhirnya masa kontrak berhak memperoleh perlindungan hukum berupa kompensasi dan ganti rugi atas sisa masa kontrak sesuai Pasal 62 Undang-Undang Ketenagakerjaan dan ketentuan PP Nomor 35\r\nTahun 2021. Selain itu, PHK secara lisan tanpa surat pemberitahuan bertentangan dengan prosedur formal PHK, sehingga dikategorikan cacat prosedural. Dalam pertimbangannya, hakim di tingkat pertama dan kasasi menilai bahwa perusahaan tidak mampu membuktikan alasan sah PHK, sehingga perusahaan wajib membayar\r\nganti rugi penuh kepada pekerja. Putusan tersebut menegaskan adanya kepastian hukum bagi pekerja PKWT dan menjadi preseden penting bahwa pengusaha tidak\r\ndapat mengakhiri kontrak secara sepihak tanpa dasar dan prosedur yang sah.
