Fokus analisis ini \r\nadalah analisis atas pertimbangan hukum hakim berdasarkan Putusan Nomor \r\n21/Pdt.SUS-Paten/2021/PN.Niaga.Jkt.Pst dan penerapan upaya penyelesaian \r\nsengketa paten invensi Indonesia terdaftar yang diklaim oleh Badan Hukum India \r\ndalam \r\npertimbangan \r\nhukum \r\npada \r\nPutusan \r\nNomor 21/Pdt.SUS\r\nPaten/2021/PN.Niaga.Jkt.Pst. Penelitian ini menggunakan metode yuridis normatif \r\ndengan pendekatan kasus, serta teori perlindungan hukum dan kepastian hukum. \r\nHasil penelitian ini menunjukkan bahwa pertimbangan hakim dalam Putusan \r\nNomor 21/Pdt.Sus-Paten/2021/PN Niaga Jakarta Pusat didasarkan pada penilaian \r\nkebaruan, langkah inventif, serta ketidakkonsistenan dasar hukum yang digunakan \r\nKomisi Banding Paten terhadap asas lex posterior derogat legi priori, sehingga \r\nberujung pada penolakan gugatan karena pembuktian sangat ditentukan oleh \r\nketepatan klaim, analisis prior art, dan kompetensi teknis pemeriksa maupun \r\nmajelis hakim. Dalam perspektif teori perlindungan hukum Satjipto Rahardjo, \r\npenyelesaian sengketa tersebut tidak hanya harus memenuhi ketentuan formal, \r\ntetapi juga menjamin perlindungan yang adil dan substantif bagi pemegang paten, \r\ntermasuk pihak asing.
