      "abstract": "Workers have the right to receive protection, opportunity, and fair treatment in their \r\nemployment relationship without discrimination. Especially pregnant female workers are \r\nvulnerable to discrimination. Pregnant female workers have very important maternity \r\nrights because they are directly related to the health, safety, and well-being of both mother \r\nand child. Maternity rights include leave for pregnancy, childbirth, menstruation, \r\nmiscarriage, breastfeeding rights, work time protection, and protection from dismissal. \r\nTherefore, the company, as the employer, has a responsibility to its workforce in fulfilling \r\ntheir rights. Based on this background, it is necessary to study how gender justice is \r\napplied in fulfilling the maternity rights of pregnant female workers at PT. KINE Project, \r\nviewed in light of Law Number 13 of 2003 concerning Labor. And what are the legal \r\nefforts of workers and the responsibility of PT. KINE Project in fulfilling the maternity \r\nrights of pregnant female workers? The theories used in this study are gender theory and \r\nthe theory of legal certainty. The method used is the empirical juridical method. In this \r\napproach, researchers use legal data sources, including primary law such as statutes and \r\nregulations, and focus on collecting and analyzing data that is tangible and observable. \r\nThe results of this study indicate that pregnant female workers are entitled to their \r\nmaternity rights as a form of gender justice within the company. PT. KINE Project has not \r\nbeen fully realized across the board, as there are still disparities in the fulfillment of \r\nmaternity rights for pregnant female workers. Normatively, the company has complied \r\nwith the provisions of Law Number 13 of 2003 concerning Manpower. The absence of \r\nlegal remedies for female workers. When their maternity rights are not fulfilled due to a \r\nlack of knowledge or the absence of socialization regarding maternity rights of workers, \r\nthis indicates a gap between legal provisions and the reality on the ground. The \r\nCompany's responsibility in the PT. KINE Project has not been implemented optimally due \r\nto the lack of facilities that support the maternity rights of female workers.",

      "note": "Tenaga kerja memiliki hak untuk memperoleh perlindungan, kesempatan, dan perlakuan \r\nadil dalam hubungan kerja tanpa diskriminasi. Khususnya tenaga kerja perempuan hamil \r\nyang rentan dari diskriminasi. Tenaga kerja perempuan hamil memiliki hak maternitas \r\nyang sangat penting karena berkaitan langsung dengan kesehatan, keselamatan, serta \r\nkesejahteraan ibu dan anak. Hak maternitas meliputi cuti hamil, melahirkan, menstruasi, \r\nkeguguran, hak menyusui, perlindungan waktu kerja, dan perlindungan dari pemutusan \r\nhubungan kerja. Maka, perusahaan sebagai pemberi kerja memiliki tanggung jawab \r\nkepada tenaga kerja dalam pemenuhan hak tenaga kerja. Berdasarkan latar belakang \r\ntersebut perlu dikaji tentang bagaimana keadilan gender dalam pemenuhan hak maternitas \r\ntenaga kerja perempuan hamil di PT. KINE Project ditinjau dengan Undang-Undang \r\nNomor 13 tahun 2003 tentang Ketenagakerjaan? Dan bagaimana upaya hukum pekerja \r\ndan tanggung  jawab PT. KINE Project dalam pemenuhan hak maternitas tenaga kerja \r\nperempuan hamil?. Teori yang digunakan pada penelitian ini adalah teori gender dan teori \r\nkepastian hukum. Metode yang digunakan adalah metode yuridis empiris. Dalam \r\npendekatan ini, peneliti menggunakan sumber data hukum, baik hukum primer seperti \r\nundang-undang, peraturan, dan berfokus pada pengumpulan dan hasil analisis data yang \r\nbersifat nyata dan terobservasi. Hasil penelitian ini menunjukkan bahwa tenaga kerja \r\nperempuan hamil berhak mendapatkan hak maternitasnya sebagai bentuk keadilan gender \r\ndalam perusahaan. PT. KINE Project belum sepenuhnya terwujud secara menyeluruh, \r\nkarena masih terdapat ketimpangan dalam pemenuhan hak-hak maternitas tenaga kerja \r\nperempuan hamil. Secara normatif, perusahaan telah menjalankan sebagian ketentuan \r\nUndang-Undang Nomor 13 tahun 2003 tentang Ketenagakerjaan. Tidak ditemukannya \r\nupaya hukum pekerja perempuan ketika hak maternitasnya tidak terpenuhi karena \r\nminimnya pengetahuan atau tidak adanyan sosialisasi terkait hak maternitas tenaga kerja, \r\nhal ini menunjukan adanya kesenjangan antara ketentuan hukum dan kenyataan \r\ndilapangan. Tanggung jawab perusahaan di PT. KINE Project ini belum terlaksana secara \r\noptimal karena tidak tersedianya fasilitas yang mendukung hak maternitas tenaga kerja \r\nperempuan."
