Customary law communities play an important role in the social and cultural structure of Indonesia, but their rights are often marginalized due to the less accommodative development of national law. Article 18B paragraph (2) of the 1945 Constitution has recognized the existence of indigenous communities and their traditional rights, but this recognition still faces various obstacles in its implementation. Identification of the problem in this research is, How is the Form of Government Protection for Customary Law Communities Viewed from the 1945 Constitution? And how urgent is the regulation of customary law communities as viewed from the 1945 Constitution?. The theories used in this research are the Theory of the Rule of Law and the Theory of Human Rights from the perspective of Economic, Social, and Cultural aspects. The method used in the research is Normative Juridical. Secondary data sources. Data collection techniques were carried out through library research. Data were obtained and analyzed descriptively with a qualitative approach. This research explains that the rights of indigenous peoples have been recognized in the 1945 Constitution and various laws, but their implementation is Hampered due to the absence of clear standards regarding the criteria for formally recognized customary law communities, resulting in legal vulnerabilities, lack of official recognition, and limited access to effective legal protection, making the recognition merely normative without real protection.Recommending the need for clearer and more comprehensive regulatory reforms, including the enactment of the Draft Law on Customary Law Communities as a form of more concrete legal protection.The government must also strengthen mechanisms for the recognition and protection of indigenous communities through inclusive policies and by involving active participation from the indigenous communities themselves. %Z Urgensi pengaturan perlindungan masyarakat hukum adat dalam perspektif UndangUndang Dasar 1945. Masyarakat hukum adat memiliki peran penting dalam struktur sosial dan budaya Indonesia, namun hak-hak mereka sering kali terpinggirkan akibat perkembangan hukum nasional yang kurang akomodatif. Pasal 18B ayat (2) UndangUndang 1945 telah mengakui keberadaan masyarakat adat dan hak-hak tradisionalnya, tetapi pengakuan ini masih menghadapi berbagai kendala dalam implementasinya. Identifikasi Masalah dalam penelitian ini yaitu, Bagaimana Bentuk Perlindungan Pemerintah Terhadap Masyarakat Hukum Adat Ditinjau Dari Undang-Undang Dasar 1945? Serta Bagaimana Urgensi Pengaturan Masyarakat Hukum Adat Ditinjau Dari Undang-Undang Dasar 1945?. Teori yang digunakan dalam penelitian ini adalah Teori Negara Hukum dan Teori Hak Asasi Manusia dalam perspektif Ekonomi, Sosial, dan Budaya. Metode dalam Penelitian yang digunakan adalah Yuridis Normatif. Sumber data sekunder. Teknik Pengumpulan data dilakukan dengan penelitian kepustakaan. Data diperoleh dan dianalisis secara deskriftif dengan pendekatan kualitatif. Hasil Penelitian ini menjelaskan bahwa Hak-hak masyarakat adat telah diakui dalam UndangUndang Dasar 1945 dan berbagai undang-undang, namun pelaksanaannya terhambat karena belum adanya standar jelas mengenai kriteria masyarakat hukum adat yang diakui secara formal, sehingga menimbulkan kerentanan hukum, kurangnya pengakuan resmi, dan terbatasnya akses perlindungan hukum yang efektif, membuat pengakuan tersebut hanya bersifat normatif tanpa perlindungan nyata. Merekomendasikan adanya reformasi regulasi yang lebih jelas dan komprehensif, termasuk pengesahan Rancangan Undang-Undang Masyarakat Hukum Adat sebagai bentuk perlindungan hukum yang lebih konkret. Pemerintah juga harus memperkuat mekanisme pengakuan dan perlindungan terhadap masyarakat adat melalui kebijakan yang inklusif serta melibatkan partisipasi aktif dari komunitas adat itu sendiri.
