Customary law communities play an important role in the social and cultural structure of Indonesia, but their rights are often marginalized due to the less accommodative development of national law. Article 18B paragraph (2) of the 1945 Constitution has recognized the existence of indigenous communities and their traditional rights, but this recognition still faces various obstacles in its implementation. Identification of the problem in this research is, How is the Form of Government Protection for Customary Law Communities Viewed from the 1945 Constitution? And how urgent is the regulation of customary law communities as viewed from the 1945 Constitution?. The theories used in this research are the Theory of the Rule of Law and the Theory of Human Rights from the perspective of Economic, Social, and Cultural aspects. The method used in the research is Normative Juridical. Secondary data sources. Data collection techniques were carried out through library research. Data were obtained and analyzed descriptively with a qualitative approach.
