description: Children born out of wedlock often face legal and social discrimination  due to being born outside a lawful marriage. In Indonesia’s legal system, the  status of such children has evolved significantly following the Constitutional  Court Decision No. 46/PUU-VIII/2010, which permits civil legal relations  between a child born out of wedlock and their biological father if it can be  legally proven. This study aims to analyze the legal considerations of the  Supreme Court in Decision No. 1055 K/Pdt/2023 regarding the acknowledgment  of children born out of wedlock and to examine its legal consequences based on  Law Number 16 of 2019 and the Compilation of Islamic Law. The research  employs a normative juridical method with statutory and case approaches. Data  was obtained through literature review and interviews with relevant sources. The  findings show that the Supreme Court recognized the child without requiring  DNA testing, relying instead on testimonies and legally admissible evidence.  This decision marks a progressive shift in legal understanding, offering broader  protection for children born out of wedlock not only in civil law but also in  emotional and psychological aspects. Moreover, this ruling sets an important  precedent that emphasizes justice and legal certainty, reinforcing the legal  standing of children born out of wedlock within both national law and Islamic  law frameworks.
