description: Marriage is a sacred institution under Indonesian law, recognized only between a  man and a woman. However, with the growing discourse on human rights and the  presence of LGBT communities, same-sex marriage has emerged as a  phenomenon, often conducted through unlawful means such as identity  falsification. This study aims to examine the legal basis for marriage annulment in  the context of a lesbian partner and to analyze the judicial considerations in the  Religious Court Decision Number 1679/Pdt.G/2020/PA Smn. The research  employs a normative juridical method with a qualitative approach, supported by  the theory of legal certainty and the theory of judicial consideration. Data were  collected through the study of primary, secondary, and tertiary legal materials.  The findings reveal that the annulment request was based on Article 27 of Law  Number 1 of 1974 and Article 72 of the Compilation of Islamic Law. However,  the court rejected the petition on the grounds that sexual orientation is not  included as a valid legal reason for annulment. The panel of judges emphasized  that a marriage is considered valid as long as it fulfills the essential and formal  requirements as regulated by law. This rejection highlights the limitations of  current legal norms in responding to evolving social dynamics, particularly those  involving sexual orientation deviations within marital relationships. The court  considered that the petition should not be granted because it viewed the case as  more appropriately serving as grounds for divorce, not for annulment of marriage.
