This legislative measure nullifies core provisions within Law Number 8 of 2010, which previously served as lex specialis in combating money laundering activities. This investigation seeks to examine the harmonization of criminal provisions and regulatory frameworks between these two legislative instruments, alongside their implications for legal certainty principles.Employing normative juridical research methodology, this study conducts a comparative analysis of substantive elements, constituent components, and penal sanctions across both legal regimes. Research findings reveal substantial disparities, including a reduction in maximum imprisonment threats from 20 years to 15 years for active perpetrators and modifications to the fine system structure. Although the new Criminal Code streamlines normative standards while preserving culpability elements encompassing intentional conduct (dolus) and negligence (culpa), these alterations potentially generate legal uncertainty in practical implementation. Concerning lex temporis delicti, money laundering cases occurring subsequent to the effective implementation of the new Criminal Code (January 2, 2026, pursuant to Article 624 of the new Criminal Code) will inevitably encounter crimes characterized as transtempus delicti – offenses whose temporal commission spans multiple legislative periods.The principle of lex favor reo (transitional provision) ensures that no individual may receive punishment exceeding existing statutory parameters. State-imposed sanctions upon citizens for past criminal conduct, when regulatory amendments occur, must be grounded in legislation containing lighter penal threats. Consequently, through the lex favor reo principle, money laundering offenses committed by perpetrators during transtempus delicti periods shall be subject to penalties specified in Article 607 paragraph (1) letters a and b of the new Criminal Code.
