The difference in the two decisions is the application of criminal sanctions, where not all decisions take into account the death of the fetus in the indictment of the Public Prosecutor. Based on this background, the problem identification studied is how the application of criminal sanctions against perpetrators of domestic violence against pregnant women which results in the death of the fetus and how legal protection for pregnant women and fetuses or children in the womb as victims of domestic violence according to legislation. The   theory used is the theory of the purpose of punishment and legal protection, with normative juridical methods through statutory and case approaches. The data used   is secondary data from primary and secondary legal materials with literature study data collection techniques. The result of this study is that the fetus was not taken   into account in the Kuala Simpang District Court Decision Number 202/Pid.Sus/2015/PN.Ksp because the perpetrator's actions did not have a deliberate motive to endanger the fetus in contrast to the Pelalawan District Court Decision Number 101/Pid.Sus/2013/PN.Plw. However, the element of intentionality with a conscious possibility or dolus eventualis needs to be considered by the Public Prosecutor in preparing the indictment. The conclusion that can be drawn is the need for accuracy in applying sanctions against perpetrators and in providing legal protection to victims.
