Kanwil Kemenkumham Banten, Promosi Jabatan, Sistem Merit note: Sistem merit merupakan salah satu pilar utama yang menekankan bahwa pengisian jabatan harus didasarkan pada kualifikasi, kompetensi, dan kinerja pegawai. Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 8 Tahun 2021 hadir sebagai dasar hukum pelaksanaan sistem merit dalam manajemen kinerja PNS di Kanwil Kemenkumham Banten. Identifikasi masalah dalam penelitian ini adalah bagaimana implementasi sistem merit berbasis kompetensi dalam proses promosi jabatan di Kanwil Kemenkumham Banten serta hambatan dan solusi yang dihadapinya. Teori yang digunakan dalam penelitian ini, yaitu hukum kepegawaian dan Good Governance. Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris dengan jenis penelitian kualitatif bersifat deskriptif. Pelaksanaan promosi jabatan di Kanwil Kemenkumham Banten telah mengacu pada sistem merit berbasis kompetensi sebagaimana tercantum dalam Pasal 5 Permenkumham Nomor 8 Tahun 2021. Dari total 52 orang pegawai yang mendaftar untuk mengikuti proses promosi jabatan, hanya 5 orang yang berhasil dipromosikan melalui penerapan empat unsur utama manajemen karier, yaitu perencanaan, pengembangan, manajemen talenta, dan pola karier. Pelaksanaan sistem ini masih terkendala oleh resistensi pegawai terhadap promosi karena faktor kenyamanan posisi, standar kompetensi jabatan yang belum optimal, serta kurangnya sosialisasi dan pemahaman pegawai mengenai sistem merit. Kesimpulannya implementasi sistem merit dalam promosi jabatan di Kanwil Kemenkumham Banten telah dilakukan dengan mengacu Pasal 5 Permenkumham Nomor 8 Tahun 2021. Hasil ini mencerminkan bahwa sistem promosi jabatan yang diterapkan benar-benar menekankan pada sistem merit. Sarannya, yaitu peningkatan sosialisasi mengenai prinsip-prinsip dan mekanisme sistem merit, serta meningkatkan internalisasi nilai meritokrasi melalui penguatan budaya organisasi. abstract: The merit system is one of the main pillars that emphasizes that filling positions must be based on employee qualifications, competencies, and performance. Regulation of the Minister of Law and Human Rights Number 8 of 2021 is present as the legal basis for the implementation of the merit system in civil servant performance management at the Banten Kemenkumham Regional Office. The identification in this study is how the implementation of the competency-based merit system in the job promotion process at the Banten Kemenkumham Regional Office and the obstacles and solutions faced. The theories used in this study are personnel law and Good Governance. The method used in this study is the empirical juridical method with a descriptive qualitative research type. The results of the study show that the Banten Kemenkumham Regional Office has implemented a competency based merit system in the job promotion process in accordance with Article 5 of Permenkumham Number 8 of 2021. Of the total 52 employees who registered to take part in the job promotion process, only 5 people were successfully promoted through the application of the four main elements of career management, namely planning, development, talent management, and career patterns. However, the implementation of this system is still hampered by employee resistance to promotion due to position comfort factors, suboptimal job competency standards, and lack of socialization and employee understanding of the merit system. In conclusion, the implementation of the merit system in job promotions at the Banten Kemenkumham Regional Office has been carried out with reference to Article 5 of Permenkumham Number 8 of 2021. These resulxuts reflect that the job promotion system implemented really emphasizes the merit system.
