"The merit system is one of the main pillars that emphasizes that filling positions \r\nmust be based on employee qualifications, competencies, and performance. \r\nRegulation of the Minister of Law and Human Rights Number 8 of 2021 is present \r\nas the legal basis for the implementation of the merit system in civil servant \r\nperformance management at the Banten Kemenkumham Regional Office. The \r\nidentification in this study is how the implementation of the competency-based merit \r\nsystem in the job promotion process at the Banten Kemenkumham Regional Office \r\nand the obstacles and solutions faced. The theories used in this study are personnel \r\nlaw and Good Governance. The method used in this study is the empirical juridical \r\nmethod with a descriptive qualitative research type. The results of the study show \r\nthat the Banten Kemenkumham Regional Office has implemented a competency\r\nbased merit system in the job promotion process in accordance with Article 5 of \r\nPermenkumham Number 8 of 2021. Of the total 52 employees who registered to \r\ntake part in the job promotion process, only 5 people were successfully promoted \r\nthrough the application of the four main elements of career management, namely \r\nplanning, development, talent management, and career patterns. However, the \r\nimplementation of this system is still hampered by employee resistance to promotion \r\ndue to position comfort factors, suboptimal job competency standards, and lack of \r\nsocialization and employee understanding of the merit system. In conclusion, the \r\nimplementation of the merit system in job promotions at the Banten Kemenkumham \r\nRegional Office has been carried out with reference to Article 5 of Permenkumham \r\nNumber 8 of 2021. These resulxuts reflect that the job promotion system \r\nimplemented really emphasizes the merit system. The suggestions are to increase \r\nsocialization regarding the principles and mechanisms of the merit system, and to \r\nincrease the internalization of meritocratic values by strengthening organizational \r\nculture."^^ .
