Regulation of the Minister of Law and Human Rights Number 8 of 2021 is present as the legal basis for the implementation of the merit system in civil servant performance management at the Banten Kemenkumham Regional Office. The identification in this study is how the implementation of the competency-based merit system in the job promotion process at the Banten Kemenkumham Regional Office and the obstacles and solutions faced. The theories used in this study are personnel law and Good Governance. The method used in this study is the empirical juridical method with a descriptive qualitative research type. The results of the study show that the Banten Kemenkumham Regional Office has implemented a competency based merit system in the job promotion process in accordance with Article 5 of Permenkumham Number 8 of 2021. Of the total 52 employees who registered to take part in the job promotion process, only 5 people were successfully promoted through the application of the four main elements of career management, namely planning, development, talent management, and career patterns. However, the implementation of this system is still hampered by employee resistance to promotion due to position comfort factors, suboptimal job competency standards, and lack of socialization and employee understanding of the merit system. In conclusion, the implementation of the merit system in job promotions at the Banten Kemenkumham Regional Office has been carried out with reference to Article 5 of Permenkumham Number 8 of 2021. These resulxuts reflect that the job promotion system implemented really emphasizes the merit system.
