This research applies international legal theory, focusing on the jurisdiction of international courts and the principle of obligation erga omnes partes. The methodology employed is a normative juridical approach with a case study and descriptive-analytical specifications, utilizing secondary data obtained through library research. The research’s findings indicate that South Africa has legal standing to sue Israel based on Article IX of the 1948 Genocide Convention, which grants states parties the right to bring disputes concerning violations of the convention. However, ICJ jurisdiction can only be accepted if both disputing states consent to the ICJ's authority, which in this case is rejected by Israel. Despite South Africa's right to sue, the legal process at the ICJ is obstructed by Israel's refusal to recognize the ICJ's jurisdiction.
