description: The development of the era has caused a shift in values and behavior in society, including the increasing practice of cohabitation or living together outside of a legal marriage. Responding to this phenomenon, Law Number 1 of 2023 concerning the Criminal Code (KUHP) presents a new regulation through Article 412 which regulates cohabitation as a criminal act. The identification of the problem in this study is, first, how the legal politics behind the regulation of cohabitation in Law Number 1 of 2023 concerning the Criminal Code. Second, how cohabitation is regulated in Law Number 1 of 2023 concerning the Criminal Code. The research method used in this study is a Normative Jurisprudence, with a statutory approach, conceptual approach, and a historical approach which are then presented descriptively. The results of the study indicate that the determination of cohabitation as an absolute complaint offense is a middle ground based on considerations of religious values, morals, and the right to individual privacy. However, the formulation of norms in Article 412 has not provided clarity on one of the elements in the article, namely regarding living together as husband and wife, thus creating the potential for multiple interpretations and legal uncertainty. On the other hand, the regulations of cohabitation as a complaint offense reflects caution in enforcing the law against the private sphere. The legal formulation of the crime of cohabitation needs to be reconsidered to ensure normative clarity, prevent inconsistencies in application, and remain aligned with the values of Pancasila and the needs of Indonesian society.
