description: Sexual violence is a crime that frequently occurs in Indonesian society, especially among vulnerable groups including Persons with Mental Disorders (PWD). However, legal protection in cases of sexual violence against PWD has not been fully effective. Based on this, the main issues examined in this study are how human rights perspectives apply to Persons with Mental Disorders who experience sexual violence and how criminal legal protection is provided for PWD who become victims of sexual violence. This research uses human rights theory and legal protection theory. This research is a type of qualitative research conducted using normative legal methods. The data sources used are secondary data sources consisting of primary, secondary and tertiary legal materials analyzed using analytical descriptive methods. The results of this study indicate that there is discrimination in fulfilling human rights for PWD, especially the right to obtain legal protection. IL, as a victim of sexual violence, has not received adequate legal protection because the case was not pursued due to the police considering it a complaint offense and no formal report was filed, resulting in the case being neglected. This contradicts the provisions of Law Number 12 of 2022 concerning Sexual Violence Crimes Article 7, which states that sexual violence against PWD is not a complaint offense, so law enforcement officers must process the case even without a formal complaint. The conclusion of this study is that sexual violence against PWD is a clear violation of human rights where the state has an obligation to fulfill the human rights of all its citizens without discrimination. Legal protection is one form of fulfilling human rights. The recommendations of this study include the need to improve the understanding and competence of law enforcement officers in handling cases of sexual violence against PWD and there is a need for public education to eliminate stigma against PWD as well as to raise awareness about the importance of protecting vulnerable groups.
