description: The pattern of sanctions in the new Criminal Code, namely by reducing the punishment and/or being subject to action, clashes with the principles adopted in the convention. Meanwhile, the existence of action sanctions contained in Article 38 of Law Number 1 Year 2023 concerning the Criminal Code. Then there are obstacles in the judicial process that make it difficult for perpetrators of crimes with   disabilities to get a fair and inclusive trial. The problem identification in this study is first, how are the sanctions imposed on criminals with disabilities in the Convention on the Rights of Persons with Disabilities and Law Number 1 of 2023 concerning the Criminal Code, second, how are the efforts of law enforcement officials in creating a fair and inclusive trial for criminals with disabilities. The   theory used is the theory of legal interpretation and law enforcement. The method used is the juridical-normative research method, with the research specifications of   the statutory approach and the literature approach. The results of the research obtained are the imposition of sanctions for criminals with disabilities needs a more   humane punishment, the new Criminal Code provides an option where criminals with disabilities get sanctions in accordance with their conditions. Furthermore,   facilities and infrastructure in correctional institutions are still an obstacle to implementing coaching programs for prisoners with disabilities. The conclusion that article 38 of the new Criminal Code still requires further explanation and fair and inclusive judicial enforcement has not been fulfilled. The researcher's suggestion is to revise Law Number 1 of 2023 concerning the Criminal Code or Law Number 8 of 2016 concerning persons with disabilities and the provision of   evaluation institutions and community participation.
