Although the land has  been legally endowed, conflicts have arisen between two foundations, the Balung Tomb  Waqf Foundation (YWMB) and the Balung Tomb Foundation (YMB), which claim rights  over the management of the land. This research is important to highlight the gap between  practice (das sein) and legal norms (das sollen), as well as the need for a fair dispute  resolution mechanism that guarantees maximum waqf benefits. The theory that I use in this  research is the theory of Legal Certainty and Legal Justice. This research is empirical  juridical, in the sense that I use secondary and tertiary, legal research conducted by  analyzing existing legal materials to understand how legal norms are applied in practice  shows that the Management and Utilization of Waqf has been carried out optimally in  accordance with Law Number 41 of 2004 concerning Waqf with a focus on effectiveness,  legal compliance, and the social impact of its implementation. Waqf land has a strategic  position in the social and religious life of the Indonesian people, one of which is the Balung  Tomb Waqf land in Cilegon which has been used for decades by the community as a public  burial ground, but in practice there are various serious problems related to the  management and utilization of the Balung Tomb Waqf land.
