This study raises the issue of the\r\napplication of interest based on an agreement in an agreement between the\r\nparties based on Article 1767 of the Civil Code which specifically examines the\r\nDecision of the Serang District Court Number 8/Pdt.Gs/2024/Pn.Srg by raising\r\nthe identification of the problem of how the application of interest according to\r\nthe agreement between the parties based on Article 1767 of the Civil Code in\r\nCourt practice in Indonesia, and what is the basis for the Judge's legal\r\nconsiderations regarding the interest agreed upon by the parties based on Article\r\n1767 of the Civil Code in the Decision of the Serang District Court Number\r\n8/Pdt.Gs/2024/Pn.Srg. The method used is a normative legal research method\r\nthat is descriptive analytical in nature. The results of the study show that the\r\nprovisions on the amount of interest based on the agreement are still recognized\r\nin court decisions, then in practice it turns out that the amount of interest based\r\non the agreement in the agreement is generally corrected by the judge based on\r\nthe principles of appropriateness and justice. The basis for the judge's legal\r\nconsiderations regarding the interest agreed upon by the parties in the Serang\r\nDistrict Court Decision Number 8 / Pdt.Gs / 2024 / Pn.Srg remains valid and\r\nrecognized in practice. However, the judge's legal considerations that reduced the\r\ninterest by 10% to 1% per month in his decision The judge was not able to\r\nprovide strong legal reasons and considerations (onvoldoende gemotiveerd) so\r\nthat the decision could not be maintained. This study suggests that the courts\r\nprepare and make clear and fair regulations regarding interest in agreements,\r\nand it is important for judges to include clear arguments to provide legal\r\ncertainty."^^<http://www.w3.org/2001/XMLSchema#string> .
