In Decision No. 60/PUU-XXII/2024, the Constitutional Court included specific figures for the percentage of the regional head elections threshold from the Political Party route which was adjusted to the nomination from the individual route. This decision raises problems, especially related to the parameters used by the Constitutional Court to test the constitutionality of the a quo article, because it is considered an open legal policy. The logical consequence of this rule of play requires that the judicial institution, namely the Constitutional Court, not be involved too much in judicial activism cases. The presence of Constitutional Court Decision No. 60/PUU-XXII/2024 also needs to be tested in order to measure the extent to which the decision is able to achieve the desired substantial goals.\r\n\r\nThis study uses a normative legal method with a statutory approach and a conceptual approach. The analysis was conducted by referring to the constitutional theory and the theory of the right to be elected and to elect. The results of the study show that: First, the Constitutional Court Decision No. 60/PUU-XXII/2024 is constitutional. This can be proven from the judge's considerations which emphasize several Articles in the 1945 Constitution of the Republic of Indonesia as the basis for reference. However, its implementation is inseparable from the potential for long-term negative impacts, especially related to the reduced space for the legislative body to reformulate the legal provisions of the threshold. The second analysis states that the Constitutional Court Decision No. 60/PUU-XXII/2024 is relevant to the implementation of local democracy but does not necessarily increase the preference for candidate leaders in the regions. This is due to the political aspects that influence it. The opening of nomination requirements through Regional Representative Council members or a combination of members and/or Regional Representative Council candidate members participating in the Election or the elimination of threshold requirements in the nomination of regional heads are efforts that can be taken to realize inclusive and democratic regional head elections"^^<http://www.w3.org/2001/XMLSchema#string> .
