However, in practice, there are still regulations that hinder the full participation of persons with disabilities in politics, particularly in candidacy for executive and legislative positions. The main obstacle lies in the requirement of "being physically and mentally capable," without clear explanations for persons with disabilities. The implementation of this right also faces challenges due to the unclear requirements set by the General Election Commission (KPU), which causes legal uncertainty and may prevent persons with disabilities from running for office, even if they meet other criteria. The research problems identified are: First, how is the implementation of the right to be elected for persons with disabilities reviewed in Law No. 7 of 2017? Second, what are the criteria for the ability to perform duties as a requirement for presidential and vice-presidential candidates, members of the People's Representative Council (DPR), members of the Regional Representative Council (DPD), and members of the Regional People's Representative Council (DPRD) for persons with disabilities? This research uses Human Rights Theory and Disability Theory. The method employed is normative legal research and empirical legal research, with a descriptive-analytical approach. Data sources are secondary, consisting of primary, secondary, and tertiary legal materials. Data collection techniques include literature studies, comparative studies, and field research, analyzed qualitatively and normatively. The findings show that first, the implementation of the right to be elected for persons with disabilities under the Election Law has been normatively granted by the state. However, its regulation does not specifically address persons with disabilities as election contestants, leading to legal uncertainty. Second, the criteria for eligibility found in this research indicate that persons with disabilities who run for or are nominated in elections must have sound mental health, while the degree of physical disability can refer to degrees 1 and 2 of the disability classification under the Ministry of Health Regulation. Second, various perspectives on the ability criteria must be accommodated to ensure persons with disabilities are not disadvantaged, as many are competent leaders. The conclusion of this research is that political rights for persons with disabilities, particularly the right to be elected, still face barriers, including the stigma of "inability." It is necessary to address various perspectives in evaluating ability and for the government to show good faith in fulfilling the electoral rights of persons with disabilities.
