However, with the existence of Article 2 Paragraph (1) of the National Criminal Code that accommodates the concept of living law, a debate arises regarding legal certainty in the application of the principle of legality. The concept of living law allows criminalisation based on the laws that live in the community, even though it is not explicitly regulated in written legislation. This is contrary to the principle of legality, which explicitly states that there is no punishment without prior written rules (nullum crimen sine lege). This difference creates problems in law enforcement, especially in ensuring legal certainty which is a fundamental element in the national legal system. This research aims to examine the problematic integration of living law to the principle of legality in the National Criminal Code and its impact on legal certainty in Indonesia. The theories used in the preparation of this research are living law theory and legal certainty theory. The method used is normative juridical method with research specification using statutory approach. The data source used is secondary data with primary, secondary, and tertiary legal materials. The type of research used is qualitative research with data collection techniques in the form of literature study. The results of this study indicate that the application of living law in the National Criminal Code has the potential to cause legal uncertainty due to diverse interpretations and the absence of standardised procedures in its implementation.
