Data from Komnas Perempuan from 2020 to 2021 has always increased cases, this has prompted the DPR to pass the Bill on the Elimination of Sexual Violence (PKS) into Law Number 12 concerning Criminal Acts of Sexual Violence (TPKS) in 2022. Of course, this is like a heavy rain when drought hits legal certainty for victims of sexual violence. But in fact, since the law was enacted, law enforcement has not yet enforced the regulation properly. In the jurisdiction of Pandeglang Police in particular, it is found that there is no case of sexual violence that has been decided using the TPKS Law, thus creating legal uncertainty. To see how far the effectiveness of law enforcement is, the author uses empirical legal research methods with qualitative research types. Some of the data sources obtained by the author come from primary data in the form of interviews with resource persons in this study, namely the PPA Unit of Pandeglang Police, as well as secondary data in the form of statutory references such as the Criminal Code and Law No. 12 of 2022 concerning TPKS. This research emphasizes on how effective the TPKS Law that has been enacted to be immediately implemented by law enforcement officials for the certainty and justice of criminal law. And also this research provides a view of the differences in regulations regarding sexual violence contained in the Law before the TPKS Law was passed, such as the PKDRT Law, TPPO Law, KUHAP, ITE Law and other regulations using a criminal law policy approach. This research opens an assessment of the legal reform of the TPKS Law that is more just for victims of sexual violence, which in previous regulations (victims) were not the subject of protected interests. Thus the existence of regulations regarding TPKS becomes a penal means and non-penal means. Penal means become an effort to "symptomatic treatment" or treat symptoms / problems that have occurred. Meanwhile, non-punitive means become an effort of "Causative Treatment" which functions to prevent the causes of criminal acts of sexual violence.
