description: Law enforcement is not solely aimed at imposing sanctions on law violators, but must also consider humanitarian values and justice. The concept of judicial pardon, or pardon granted by a judge, is part of the development of modern criminal law that seeks to balance legal certainty with the sense of justice in society. This study aims to examine how the regulation of judicial pardon can fulfill aspects of legal certainty within the Indonesian criminal law system, as well as how its application can align with the public’s sense of justice. The research method used is normative juridical, with a conceptual and comparative approach through a literature review of legislation, legal literature, and other relevant documents. The results show that although the concept of pardon has been recognized in the living law within society, its formal and material regulation in the national legal system remains unclear and insufficient. Furthermore, harmonization between the new Criminal Code (KUHP) and the Criminal Procedure Code (KUHAP) is necessary so that the application of judicial pardon by judges can be carried out effectively and in accordance with the principles of justice. Therefore, criminal law reform in Indonesia must include the formulation of more comprehensive regulations concerning the practical implementation of judicial pardon as one of the instruments in equitable law enforcement.
