In some cases, even though the limit price is determined based on an assessment by a Public Appraisal Service Office (Kantor Jasa Penilai Publik – KJPP), debtors believe that the valuation does not reflect the fair market value of the collateral. This has led some debtors to seek a reassessment from another KJPP, resulting in significantly higher market and liquidation values compared to the limit price set by the creditor. In certain instances, the limit price determined by the creditor is even lower than the liquidation value obtained by the debtor’s reassessment, raising concerns about fairness and transparency in the auction process. This study aims to analyze the mechanism of mortgage right execution auctions, the legal protection available to debtors, and the legal remedies that can be pursued when the limit price falls below the liquidation value. This research adopts a normative-empirical legal approach, utilizing statutory and case study analysis. The findings indicate that although KJPP assessments are intended to ensure transparency and objectivity, discrepancies between the valuation results of different KJPPs create legal uncertainty. Creditors tend to set the limit price based on the lower liquidation value, which may disadvantage debtors by reducing their chances of receiving any remaining proceeds from the sale of their collateral. To safeguard debtor rights, auction procedures must uphold principles of transparency, provide debtors with access to valuation reports before the auction, and allow them the opportunity for private sales to secure a better price. If debtors feel harmed, they may pursue legal remedies through civil lawsuits against creditors or administrative objections to challenge the auction process.
