Business practices through partnership relationships in Indonesia are listed in Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises (UMKM Law). However, in the implementation of the partnership relationship between driver partners and PT Maxim, there are many obstacles that are detrimental to maxim driver partners, namely the existence of fictitious orders made by fellow drivers for personal gain. The problem of fictitious orders among drivers is then rampant in Serang City, maxim driver partners experience losses in terms of time and material. This study aims to determine and analyze the legal protection of maxim driver partners who experience losses due to fictitious orders from fellow drivers and to determine and analyze PT Maxim's responsibility due to the losses of maxim driver partners who experience fictitious orders. The research method used is normative juridical method supported by empirical juridical method and analyzed qualitatively. The result of this research is the absence of special provisions regarding legal protection of maxim drivers as an online motorcycle taxi partner, especially in Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises which causes an imbalance of rights and obligations in the Maxim License Agreement and results in harm to maxim drivers because drivers as partners until now are still difficult to get justice and their rights as a partner due to their status which is not included in the workforce. PT Maxim in its standard agreement states that it is not responsible for the loss of maxim driver partners due to fictitious orders.
