Insiden kecelakaan pesawat ini menyebabkan banyak korban jiwa dan kerugian materiil yang luar biasa, yang memunculkan pertanyaan mengenai tanggung jawab perusahaan pembuat pesawat. Fokus utama tulisan ini adalah menganalisis apakah Boeing sebagai manufaktur pesawat dapat dipertanggungjawabkan dalam konteks hukum internasional dan peraturan yang berlaku, khususnya yang diatur dalam Konvensi Montreal 1999, yang mengatur tanggung jawab maskapai penerbangan terhadap penumpang dan barang mereka. Penelitian dikaji menggunakan teori tanggung jawab hukum dan teori keadilan. Penelitian ini dilakukan dengan metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis dan data sekunder. pengumpulan data tersebut melalui studi kepustakaan kemudian dianalisis secara kualitatif. Hasil dari penelitian ini dapat disimpulkan bahwa Konvensi Montreal 1999 hanya mengatur hubungan hukum dan tanggung jawab antara pengangkut udara (maskapai) dan penumpang, serta antara pengangkut udara dengan pihak lain yang seharusnya bertanggung jawab atas kecelakaan pesawat atau akibatnya, seperti luka atau kematian penumpang. Dalam hal ini, Lion Air wajib memberikan ganti rugi awal sebesar Special Drawing Rights (SDR) 113.100 kepada setiap penumpang terlebih dahulu. Selanjutnya, Lion Air dapat mengaktifkan Pasal 37 Konvensi Montreal 1999 untuk meminta pertanggungjawaban dari Boeing terkait kecelakaan Pesawat Lion Air JT 610. Setelah pasal ini diaktifkan, maka ganti rugi yang telah dibayarkan oleh Lion Air kepada penumpang akan digantikan dengan ganti rugi yang dibayarkan oleh Boeing. Dengan demikian, terciptalah hubungan hukum dan pertanggungjawaban tidak langsung dari Boeing terhadap penumpang pesawat Lion Air JT 610. abstract: The responsibility of aircraft manufacturers, especially the Boeing Company, for the crash of Lion Air JT-610 on October 29, 2018, in the perspective of international law, concerning the 1999 Montreal Convention. The incident of this plane crash caused many casualties and tremendous material losses, which raises questions regarding the responsibility of aircraft manufacturing companies. The main focus of this paper is to analyze whether Boeing as an aircraft manufacturer can be held liable in the context of international law and applicable regulations, especially those stipulated in the 1999 Montreal Convention, which regulates the responsibility of airlines for passengers and their goods. The research is examined using the theory of legal responsibility and the theory of justice. This research used the normative juridical method with descriptive-analytical research specifications and secondary data. The data collection was through a literature study and then analyzed qualitatively. The results of this study can be concluded that the 1999 Montreal Convention only regulates the legal relationship and responsibilities between air carriers (airlines) and passengers, as well as between air carriers and other parties that should be responsible for aircraft accidents or their consequences, such as injury or death of passengers. In this case, Lion Air must provide initial compensation of Special Drawing Rights (SDR) 113,100 to each passenger first. Furthermore, Lion Air can activate Article 37 of the 1999 Montreal Convention to hold Boeing liable for the Lion Air JT 610 crash. Once this article is activated, the compensation paid by Lion Air to passengers will be replaced by the compensation paid by Boeing.
