The incident of this plane crash caused many casualties and tremendous material losses, which raises questions regarding the responsibility of aircraft manufacturing companies. The main focus of this paper is to analyze whether Boeing as an aircraft manufacturer can be held liable in the context of international law and applicable regulations, especially those stipulated in the 1999 Montreal Convention, which regulates the responsibility of airlines for passengers and their goods. The research is examined using the theory of legal responsibility and the theory of justice. This research used the normative juridical method with descriptive-analytical research specifications and secondary data. The data collection was through a literature study and then analyzed qualitatively. The results of this study can be concluded that the 1999 Montreal Convention only regulates the legal relationship and responsibilities between air carriers (airlines) and passengers, as well as between air carriers and other parties that should be responsible for aircraft accidents or their consequences, such as injury or death of passengers. In this case, Lion Air must provide initial compensation of Special Drawing Rights (SDR) 113,100 to each passenger first. Furthermore, Lion Air can activate Article 37 of the 1999 Montreal Convention to hold Boeing liable for the Lion Air JT 610 crash. Once this article is activated, the compensation paid by Lion Air to passengers will be replaced by the compensation paid by Boeing.
