description: Theft is one of the most common types of crime in everyday life. Theft that often  occurs is theft with aggravation or by another name theft with qualification. Like  any other crime, it has legal consequences. Theft with aggravation is regulated in  Article 363 of the Criminal Code, which is then regulated in Article 479 of Law  No. 1 of 2023 concerning the Criminal Code or the new Criminal Code. The new  Criminal Code is adapted to the values of Indonesian society. Thus the  identification of problems in this study is what are the factors that influence the  occurrence of theft with aggravation and how the punishment of perpetrators of  theft with aggravation. The type of research used is normative juridical. The  presentation of this research uses a qualitative method. Data information is  collected using library research techniques using secondary data. The conclusion in  this research shows that the crime of aggravated theft is based on various factors  including economic factors, education, unemployment, victim negligence,  socialization, and lifestyle factors. The large number of cases of aggravated theft  indicates that punishment as in its purpose to prevent crime has not been  implemented. The purpose of punishment in order to overcome the crime of theft  with aggravation can be done through law enforcement. Law enforcement is closely  related to thoughts about the effectiveness of laws and regulations or applicable  laws. Legal factors as one of the factors in law enforcement, of course, with the  passing of Law No. 1 of 2023 concerning the Criminal Code has brought Indonesia  to have a better rule of law, then with a better rule of law, it requires the participation  of law enforcers and the community to obey and carry out new laws that have been  adjusted to the values of the Indonesian state.
