N1  - Skripsi ini bertujuan untuk menjelaskan dinamika kekuasaan yang dapat mengendalikan keadilan dalam pelaksanaan restorative justice untuk tindak pidana anak di Kota Tangerang. Terdapatnya pemikiran dari kaum kapitalis yang melihat restorative justice sebagai alat agar keinginannya bisa tercapai, sehingga pihak yang lebih berkuasa dapat memengaruhi hasil akhir dari proses restorative justice. Penelitian ini menggunakan teori keadilan oleh John Rawls (1971) yang mempunyai dua prinsip yakni The Principle of Greatest Equal Liberty dan Principle of Difference. Metode yang digunakan dalam penelitian ini ialah metode penelitian kualitatif dengan pendekatan fenomenologi. Hasil dari penelitian ini menunjukkan bahwa dalam pelaksanaan restorative justice untuk tindak pidana anak di Kota Tangerang masih terdapat paksaan untuk memenuhi ganti rugi dengan nominal yang tinggi. Pada kasus lainnya juga terdapat tindakan penekanan dan ancaman dari pihak yang berkuasa, sehingga sulit mendapatkan kesejahteraan dan keadilan untuk tiap-tiap pihak.

N2  - This thesis aims to explain the dynamics of power that can control justice in the implementation of restorative justice for juvenile crimes in Tangerang City. There is a thought from the capitalists who see restorative justice as a tool to achieve their desires, so that the more powerful party can influence the final result of the restorative justice process. This study uses the theory of justice by John Rawls (1971) which has two principles, namely The Principle of Greatest Equal Liberty and the Principle of Difference. The method used in this study is a qualitative research method with a phenomenological approach. The results of this study indicate that in the implementation of restorative justice for juvenile crimes in Tangerang City there is still coercion to fulfill compensation with a high nominal value. In other cases, there are also acts of pressure and threats from the powerful party, making it difficult to obtain welfare and justice for each party.
