The rules pertain ro aqidah (faith), worship, morals and mualah (social and economic transactions). Inheritance law is legal field that encompasses the regulation of the transfer of a deceased person‟s assets to one or more designated beneficiaries. The principle of ijbari is one of the principles in Islamic inheritance law which is determined and enforceable, based on the Al-Qur'an and Sunnah for its adherents, unless otherwise specified in Islamic law. The principle functions as a basis for forming laws and monitoring law so that there is an urgency to examine whether the Ijbari principle lives in Islamic inheritance law regulations in Indonesia. Identification of the problem in this research is, what are the legal provisions of the Ijbari Principle in the system of dividing inheritance property based on Islamic Law in Indonesia and how is the Ijbari Principle applied in Decision No. 2667/Pdt.G/2020/PA.Srg. This research uses a normative juridical approach, which is analyzed based on positive legal research. The research results show that the Ijbari principle has legal certainty in Islamic inheritance law regulations in Indonesia because it is regulated in material law (UU 3/2006) that Muslims are obliged (option rights are removed) to use Islamic inheritance law through religious courts in inheritance cases and have legal formal, namely in the Compilation of Islamic Law. The judge's decision not to accept the lawsuit because the lawsuit lacks parties, namely the party who controls the inheritance, is in accordance with the pillars of Islamic inheritance and prioritizes the principle of Ijbari.
