description: In criminal law, an act that has been proven guilty is not necessarily subject to  punishment, this is a principle regulated in Book I Chapter III of the Criminal Code  which contains reasons for the elimination of punishment, one of which is forced  defence that exceeds the limit (Noodweer Exces) in Article 49 paragraph 2 of the  Criminal Code. The purpose of this research is to identify the criteria that define  noodweer exces, and to find out the criminal law study of the act of noodweer exces. In  Article 49 paragraph 2 of the Criminal Code, it can be concluded that if a person  commits excessive self-defence against an attack in a state of mental shock due to an  unlawful attack. In this situation, excessive self-defence is still unlawful, but the  perpetrator is not punished due to the existence of excuses.
